Brewery Licences

BREW-PUB LICENSE

A brew-pub means a small capacity brewery which, unless otherwise approved by the Commission, produces less than 2,000 hectolitres of beer per year and is authorized by the Commission to sell only draft or bulk beer by the glass for consumption in its adjacent, totally segregated, licensed premises and at one other location which is owned and operated by the holder of the brew-pub license.

 

  1. Upon application the Commission will consider a brew-pub license if satisfied that the applicant and
    1. the premises, furnishings, equipment and facilities of the brew-pub are of a high standard;
    2. the applicant for a brew-pub license is also the holder of a liquor license which authorizes the sale of liquor to persons who are not disqualified under this Act and regulations for consumption on the premises.

     

  2. The holder of a brew-pub license shall
    1. be licensed as a brewer by the Government of Canada;
    2. manufacture beer in accordance with the Food and Drugs Act (Canada) R.S.C. 1985, Chap. F-27;
    3. be licensed under the Excise Tax Act.

       

  3. An application for a brew-pub license shall be accompanied by a non-refundable application fee of three hundred ($300.00) dollars.

     

  4. A Brew-Pub licensee shall pay an annual fee of four hundred ($400.00) dollars.
MICRO-BREWERY LICENSE

A micro-brewery means a free-standing brewery that produces less than 15,000 hectolitres of beer per year.

 

  1. The Commission will consider a micro-brewery license where
    1. the premises, furnishings, equipment and all other facilities of the micro-brewery are, in the opinion of the Commission, of a high standard;
    2. be licensed as a brewer by the Government of Canada;
    3. manufacture beer in accordance with the Food and Drugs Act (Canada); and
    4. hold a valid license issued pursuant to the Excise Tax Act (Canada). and
    5. the Commission has received a fee of $300.00 from the applicant.

     

  2. Subject to the terms and conditions of the micro-brewery license, the holder of a micro-brewery license may operate a brewery retail outlet on the premises of the brewery for the display, sale, tasting, and storage of beer produced and bottled at the micro-brewery.

     

  3. An application for a Micro Brewery license shall be accompanied by a non-refundable application fee of three hundred ($300.00) dollars.

     

  4. A Micro Brewery licensee shall pay an annual fee of five hundred ($500.00) dollars.
